Terms and Conditions

INTRODUCTION

This document is an electronic record in terms of the information technology act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes, as amended by the information technology act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signature.

This document is published in accordance with the provisions of rule 3(1) of the information technology (intermediary's guidelines) rules, 2011 that requires publishing the rules and regulations, privacy policy and terms of use for access or usage of the platform.

DEFINITIONS

For the purpose of these Terms, wherever the context so requires, the term:

"Certificate" shall mean an electronic certificate issued by MDG (digitally signed) showing the value of the bullion owned/possessed/booked by the customer.

"Customer" shall mean any individual, who as the counter party transacts using the Platform for Booking Gold (as defined below), taking/redeem of Gold/Silver at preferred store or office of the MDG.

"Customer Request" shall mean a Redeem Request placed by the Customer in relation to the Gold/Silver.

"Force Majeure Event" shall mean any event that is beyond the reasonable control of the MDG and shall include, without limitation, sabotage, fire, flood, explosion, act of God, civil commotion, strikes, lockouts or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, civil disturbances, unauthorised access to computer data and storage device, computer crashes, virus attacks, breach of security and encryption, and any other similar events not within the control of MDG and which MDG is not able to overcome.

"Gold/Silver" shall mean 24 Karat/ 22 Karat Gold/Silver of 99.90% purity, offered to the Customer by MDG under the brand name "My Dream Gold".

"Gold/Silver Account" shall mean the account created by/to in the name of the Customer or otherwise, in accordance with these Terms.

"Gold/Silver Account Information" shall mean the information provided by the Customer for the purpose of creation of the Gold/Silver Account.

"MDG" means My Dream Gold. The brand name under which the online sale of gold is offered by McGan-is- Gold.

"Payment Instrument" shall mean any electronic or written cheque, draft, money order or other electronic or written instrument or order for the transmission or payment of money, whether or not the instrument is negotiable.

"Person" shall mean an individual, corporation, partnership, joint venture, trust, an unincorporated organization or any other legal entity.

"Platform" shall mean, and include the mobile application and website by the name and style of "www.mydreamgold.com", that the Customer accesses the transactions, including all contents, services and technology offered through the Platform.

"Transfer" refers to a facility to transfer Gold/Silver from a Gold/Silver Account to another Gold/Silver Account.

"Wallet" shall mean the account of the customer.

SERVICES PROVIDED BY MDG


My Dream Gold will be delivering the Gold/Silver and providing services for safe keeping and Redeem/fulfilment of Gold/Silver and related services thereto the Customers, on or through the Platform ("Services").

The Gold/Silver is being offered for booking by MDG under its brand name "My Dream Gold". The Services are being provided by MDG. It however MDG may utilise any external Payment Gateway Service ("PG Service") for facilitating the collection of payments for the Services on its Platform. The PG Service Provider assumes no liability for the Services except for providing payment, the services and Customer Support in addressing the queries related to Support in addressing the queries related to payments made. The Customers are advised to read and understand these Terms carefully before using the Services.

MDG does not guarantee any returns, on any transactions consummated via the Platform, to any person, either directly or indirectly. The Customer shall be solely responsible for undertaking appropriate and effective due diligence and related analysis before undertaking any transaction pursuant to these Terms of Use. The customer further acknowledges and agrees that MDG and its officers, directors, employees, agents and affiliates will have no liability for Customers Booking or other decisions using the Platform.

The Services by MDG shall be provided for a term commencing from the date of creation of the Gold/Silver Account.

The Platform may contain errors or inaccuracies that could cause failures, corruption or loss of data and/or information from Customers device and/or any device used by the Customers to connect to the Platform as well as from peripherals (including, without limitation, servers and computers) connected to any of the above-mentioned devices. Customers assume all risks and costs associated with Customer's use of the Services and the Platform, including without limitation of any costs incurred for the use of Customers device and any damage to any equipment, software or data.

Customer confirms that, the Customer is not registered under the Goods and Services Tax Act, 2017 and that if, in the course of Customer relationship with MDG, any Customer becomes registered under the Goods and Services Tax Act, 2017, Customer shall inform MDG of Customer the same immediately, and provide all relevant information and documents, as may be requested.

SAFE KEEPING OF GOLD AND SILVER

Gold/Silver Booked by customers will be stored in the Customer's Wallet.

MDG will issue an electronic Certificate evidencing the value of the Bullion booked/owned by the customer.

The Gold and/or Silver stored shall be in the form of Bullion. The total amount of Gold and/or Silver stored shall be equal to the cumulative/total weight of Gold and/or Silver of 99.90% sold through MDG Platform.

MDG will not allow customers for Encashment of Wallet Balance at any cause

MDG Wallet Balance can be utilized for Redemption of Bullion/Transfer to another customer

TRANSFER OF GOLD

Customers can transfer the value of Gold / Silver to another customer through means of the "Transfer" feature.

The Transfer so made shall be final, and MDG shall not be responsible for amending, altering or otherwise reversing the transaction in case the transfer is affected to an unintended recipient due to any error on the part of the Customer.

REDEMPTION AT OUT JEWELLERY PARTNER

At the preferred shops, the customer can convert their digital Gold / Silver into physical ornaments.

Customers can redeem their booked digital Gold in the form of in the purity of Gold/Silver of 91.6% 22 Karat or 99.90% 24 Karat Ornaments at Partnered/Nominated Jewellery showrooms or in the office of the MDG or at the places specified.

If the customer wants to transfer the digital gold to any jewellery showroom and purchase jewellery, any additional charges/cost incurred towards the making, wastage, taxes shall be borne separately by the customer.

STORAGE OF GOLD

The Customers are required to redeem Customer's Gold and/or Silver within such a period (hereinafter referred to as the "Storage Period") as shall be specified for this purpose by MDG from time to time.

The Customer hereby accepts that the maximum Storage Period, which can be availed by the Customer, would be for five years along with an additional grace period of one year.

CREATION OF GOLD AND/OR SILVER ACCOUNT

For joining the Platform and before availing the Services, the Customer shall complete the MDG registration process as may be prescribed from time to time. The Customer shall follow the instructions given on the Platform for opening a Gold and/or Silver Account.

The Customer agrees that MDG shall be entitled to collect and store relevant information and documents provided by the Customer to the Platform for KYC purposes. As and when required by MDG Platform, the Customer will be required to provide additional documents for fulfilling the KYC requirements. The Customer authorizes MDG to make such enquiries as may be necessary to be satisfied with the validity of the Customer's identity. The Customer shall be responsible for the correctness of information provided to MDG, from time to time. If the Customer has reasons to believe that there is an error in the information furnished by the Customer, the Customer shall immediately thereafter provide MDG with the correct / updated information.

The Customer hereby agrees that MDG reserves its right to terminate any Gold and/or Silver Account, with notice to the Customer, in the event the KYC documents and/or the information are found to be incorrect or authenticity of the documents and/or the information is found to be doubtful.

The Customer hereby undertakes to indemnify and keep indemnified MDG, against any and all losses, claims, liabilities costs etc. which arise out of or relating to the Customer's failure to identify the Customer and validate the Customer's Account promptly and / or due to incorrect KYC documents and/or information.

At the time of creation of Gold and/or Silver Account, the Customer shall be required to provide his/her name, email address, and mobile number.

 KNOW YOUR CUSTOMER (KYC) AND VERIFICATION

Prior to placing an order, the Customers may be required to provide certain KYC documentation and other information as may be required by MDG in such form and manner as it may deem fit. This information may be requested from the Customer at the time of registration, or at a later stage. Once such documentation and other information is provided by the Customer and the same has been verified by MDG in any manner it deems fit, the Customer shall be entitled to place an order on the Platform (hereinafter referred to as "Customer Order").

The Customer hereby authorizes MDG to engage with any third-party service provider for verification of the Customer's KYC documentation to ascertain Customer's eligibility. Any processing undertaken by MDG to process KYC documents shall be in accordance with its Privacy Policy and these Terms of Use. It is hereby clarified that as far as the permission to access the KYC documents by a third-party service provider is concerned, the same shall be governed by the Privacy Policy of such third-party service provider.

CUSTOMER'S OBLIGATIONS

The Customer will be responsible for maintaining the confidentiality of the Gold and/or Silver Account Information and shall be fully responsible for all activities that occur under Customers Gold and/or Silver Account. The Customer agrees to immediately notify MDG of any unauthorized use of the Gold and/or Silver Account Information or any other breach of security.

MDG cannot and will not be liable for any loss or damage arising from Customers' failure. The Customer may be held liable for losses incurred by MDG or any user or visitor of the Platform due to authorized or unauthorized use of the Gold and/or Silver Account, because of Customer failure in keeping the Gold and/or Silver Account Information confidential.

The Customer shall ensure that the Gold and/or Silver Account information provided by the Customer in the registration form is complete, accurate, and up to date. Use of another Customer's account information for availing of any of the Services and/or for use of the Platform is expressly prohibited.

The Customer agrees that if the Customer provides any information that is untrue, inaccurate, not current or incomplete, (or becomes untrue, inaccurate, not current or incomplete) or if MDG has reasonable grounds to suspect that such information is untrue, inaccurate, not current, incomplete, or not in accordance with these Terms of Use, MDG shall have the right to indefinitely suspend or terminate or block access to the Gold and/or Silver Account on the Platform and refuse any and all, current or future, access to the Partner Platform (or any portion thereof) without any liability to the Customer.

SELL

Users can sell their gold or silver holdings through the MDG platform based on the prices displayed in the app. If the displayed prices are acceptable, users must confirm the Sell Request in the manner prescribed by MDG. Upon confirmation, the corresponding quantity of gold or silver will be debited from the user’s MDG account. Users may be required to provide valid KYC documents and other necessary information to make transactions in My Dream Gold, including initiating any buy, sale, gift, redeem, or SIP of gold or silver. Failure to provide accurate documentation may result in delayed or rejected transactions.

To initiate a sell, users must maintain minimum holdings in their MDG wallet—at least 1 gram of gold or 10 grams of silver. Payments for confirmed Sell Requests will be credited to the bank account provided by the user. It is the user’s responsibility to ensure that the bank account details, including account number, branch name, and IFSC code, are accurate. MDG will not be held liable for any delays caused by incorrect bank details.

MDG will make reasonable efforts to offer competitive prices for gold and silver, but there is no guarantee that the prices offered on the platform will match or be comparable to other market rates. Sell prices are considered final at the time of confirming the Sell Request. Applicable GST, transaction fees, processing charges, and other deductions will be subtracted from the sale proceeds. These charges will be clearly displayed to users during the sell confirmation step.

Users are responsible for ensuring they have sufficient gold or silver balance before initiating a sale. They must verify their bank account details for accurate settlement and complete KYC verification prior to any transaction in My Dream Gold. It is important to understand that market volatility may affect the sale price between the time of placing the Sell Request and the actual payment settlement.

MDG is not liable for any issues arising from incorrect bank account details provided by the user, market price fluctuations, or delays caused by banks, payment processors, or regulatory compliance checks. MDG reserves the right to update or amend these Terms and Policies at any time. Users will be notified of major changes through the app. These terms are governed by the laws of India, and all disputes shall be subject to the jurisdiction of Indian courts.

BOOKING OF GOLD / SILVER

Customer can Book Gold/Silver for any denomination but not lesser than Re.1/-. The booking is linked to the prices of gold/silver shown on the Platform. Market linked prices means the quotes are linked to the prices of gold/silver in the commercial bullion market in India. Payment will be accepted through the payment options made available on the Platform.

For more than Rupees Two Lakhs booking made by the customer or if the wallet balance exceeds Rupees Two Lakhs, the customer should submit their KYC with PAN and AADHAR, which are mandatory.

Customer can book the digital Gold/Silver either in GRAM or AMOUNT. For the amount paid by the customer, equivalent weight of Gold/Silver will accumulate in the MDG Wallet.

REDEEM CUSTOMER DIGITAL GOLD / SILVER JEWELLERY AT MDG PARTNERED JEWELLERS

At the preferred shops, If customer can convert their digital Gold / Silver into physical ornaments.

If the customer wants to transfer the digital gold to any jewellery showroom and purchase jewellery any additional charges/cost incurred towards the making wastage taxes shall be borne separately by the customer.

MDG will not be able to deliver any quantity of Gold/Silver below one gram. Bullion cannot be delivered in fraction of 1gram and Delivery will always be rounded to the nearest gram. Difference resulting due to the same is to be paid by the customer.

Customer can cancel the booking within 15 days from the date of booking and can opt for the money so paid. Upon MDG will pay back the money to the customer the account from which MDG received the amount after deducting the gateway charges.

SYSTEMATIC INVESTMENT PLAN (SIP):

These Terms govern the Systematic Investment Plan (SIP) feature available in the My Dream Gold (MDG) App. By creating, modifying, or managing a SIP, users agree to abide by these Terms, the MDG Privacy Policy, and any other applicable rules. A "User" or "Customer" refers to any individual using the MDG App services. A Gold/Silver SIP is a recurring investment plan that allows users to purchase gold or silver on a daily, weekly, or monthly basis. The "Gold Partner" is the entity responsible for providing the gold or silver, and its pricing, delivery, and product quality govern the transaction.

SIPs can be set up only through UPI autopay, as NEFT or IMPS is not applicable for recurring SIPs. The investment amount must fall between ₹30 and ₹100,000 per cycle. Payments will be debited automatically on scheduled dates, including weekends and bank holidays, as per the autopay mandate. Users must ensure that their bank account maintains sufficient balance, as MDG will retry failed payments after five days in the case of monthly SIPs. MDG is not responsible for any loss resulting from failed debits, bank errors, or technical issues.

Upon successful debit, gold or silver is allocated based on the prevailing market price, net of applicable taxes such as GST. Users can view their accumulated gold or silver in real time through the MDG wallet. While users are not permitted to pause an active SIP, they may choose to delete it at any time. MDG and its Gold Partners shall not be held liable for any potential loss resulting from SIP discontinuation.

Gold and silver prices are subject to market fluctuations, and no returns are guaranteed. Past performance does not indicate future results. Users bear all investment risks, including market gains or losses, missed SIP allocations, or delayed debits. It is the user's responsibility to maintain accurate bank account details and ensure that autopay mandates remain active. Users must monitor SIP payments and promptly report any failed or duplicate transactions. MDG functions solely as a technology and payment platform and is not involved in the pricing, quality, storage, or delivery of gold or silver. Users are expected to comply with all MDG App rules and Gold Partner policies.

The SIP amount includes GST and other applicable taxes. Users are responsible for any additional taxes, duties, or charges that may arise from SIP investments or redemption. MDG and its partners are not liable for failures caused by bank downtime, technical issues, UPI failures, or circumstances beyond MDG’s reasonable control, including natural disasters, strikes, or other force majeure events. In the event of technical issues, MDG may attempt to process debits later within the same time period, and the market price at the time of actual debit will apply.

MDG is not liable for market fluctuations, loss of investment value, errors, delays, or failures in bank transactions or UPI processing, nor for any issues related to gold or silver allocation or delivery by Gold Partners. Users agree to indemnify and hold harmless MDG, its directors, employees, affiliates, and contractors from any claims, damages, or losses arising from use of the SIP service, including disputes with Gold Partners.

These Terms are governed by the laws of India. Any disputes arising from the use of the SIP service shall first be referred to arbitration under the Indian Arbitration and Conciliation Act, 1996. Only unresolved matters following arbitration may be taken to competent courts within the user’s jurisdiction. MDG reserves the right to update or modify these Terms at any time. Users will be notified of any material changes through the MDG App, and continued use of the SIP service will constitute acceptance of the updated Terms.

By initiating a SIP, users acknowledge and accept all associated risks, responsibilities, and conditions outlined in these Terms, including exposure to market fluctuations, technical failures, and any liabilities related to Gold Partners.

PARTNER SETTLEMENT BY MY DREAM GOLD

MDG provides Partners Dashboard for accessing Redeeming and Settlement reports. Redeemed weight would be in terms of 91.60% purity (22 Carat) for Gold/Silver equivalent converted weight of 99.90% (24 Karat) purity of Gold/Silver.

Settlement would be carried out once a week.

TERMINATION OF SERVICES BY MDG

Customers can request to close their MDG account by contacting the customer support. MDG will terminate the account on request with following Disclaimer

Customers MDG account can be closed with Nil Balance only. If a customer holds any quantity of Gold / Silver in their account. Same should be taken for delivery.

Encashment of MDG wallet Balance will not be entertained at any cause.

FORCE MAJEURE

In case of inability of the Company to make Redeem of Gold and/or Silver due to Force Majeure reasons and any other reason beyond the Company's control and which could not be prevented, the Company may require that the deliveries be effectuated through specific modes. In such a case, the Customer agrees to bear any additional costs and fees necessary for the Redeem to be complete

In the event that an individual's Payment Instrument is fraudulently utilized to Booking Gold and/or Silver on the Platform (hereinafter referred to as "Fraudulent Transaction") from MDG, then the Company may share relevant information of such transaction if the victim approaches the Company via proper channels including MDG customer support number and email, along with supporting documentation from the relevant public authority or Cyber Cell. If MDG suspects that fraudulent activity has taken place within Customer Gold and/or Silver account, in order to protect the customer, The Customer understands that we may temporarily freeze Customers Gold and/or Silver account to prevent any further or continuing unauthorized activity.

USE OF THE PLATFORM AND SERVICES

Customer acknowledges that the Services are for the Customer's personal use and agree not to publish the gold/Silver prices or descriptions of gold/silver and/or any other information displayed on the Platform (in lieu of Customer's access to the Platform) on any other medium. Customer shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.

Subject to these Terms and the Privacy Policy, the Customer hereby grant to MDG a non-exclusive, worldwide, royalty-free right to (a) collect, store and transmit Customers data, in each case solely to the extent necessary to provide the Services to the Customer, and (b) share Customers data or interact with other people, to distribute and publicly perform and display the Customers data as Customer can direct or enable through the Services. The Customer will provide Customers consent to MDG as may be required under applicable law for the use and/or sharing of any data generated by the Customer when purchasing Gold or otherwise using the Platform for any services related to the purchasing of the Gold in such manner as MDG may stipulate in this regard. MDG may share Customers data with the Security Trustee, as required, to fulfil their obligations as a Security Trustee. Customer's data will continue to be governed by confidentiality obligations outlined in Section 21. It is hereby clarified that MDG would be the owner of any data generated by the Customer when purchasing the Gold on the Platform.

MDG shall not be held liable for any loss of data, technical or otherwise, information, or for particulars supplied by the Customer, due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of a Force Majeure Event.

The provision of Services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. MDG strives to keep the Services up and running; however, all online services suffer occasional disruptions and outages. MDG is not liable for any disruption or loss customer may suffer as a result.

MDG may discontinue some or all of the Services, including certain features and the support for certain devices and platforms, at any time.

SUSPENSION OR CLOSURE OF ACCOUNT

MDG may, at its discretion, suspend Gold/Silver Account of the Customers, if there appears to be a fraudulent or suspicious activity in the account. If MDG is of the opinion that the Customer is involved in any unlawful activity or the Gold Account is used for any unlawful purpose. MDG shall have the right to take all actions available to it, including black-listing or blocking the Customer from using the Services on its Platform or blocking Customer access to the Services through the Platform or intimating the relevant authorities of such unlawful activities. MDG shall not be held liable / responsible, in any manner whatsoever, for any loss / liability arising out of or relating to any technical failure / issue in Platform and/or acts / omission not attributable to it.

The Customer shall inform immediately, in any case no later than five days of the transaction, of any irregularities or discrepancies that may exist in Customers Gold/Silver Account, failing which it shall be deemed that there is no error or discrepancy in the account. All records maintained by MDG, in electronic or documentary form of the instructions of the Customer and such other details (including, but not limited to payments made or received) pursuant to the Terms, shall as against the Customer, be deemed to be conclusive evidence of such instructions.

MEMBER ELIGIBILITY

Use of the Platform and/or the Services is available only to persons who can enter into legally binding contracts under the Indian Contract Act, 1872 and to persons resident in India. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents and persons' of unsound mind are not eligible to use the Platform or the Services. Any person under the age of 18 shall not register on the Partner Platform and shall not transact on or use the Partner Platform in relation to or for any Services. MDG reserves the right to terminate any Person's membership and/or refuse to provide such Person with access to the Platform and/or any Services if it is brought to the notice of MDG or if it is discovered that such Person is not eligible to use the Platform and/or any Service.

ABSENCE OF RELATIONSHIP

The Customer represents and warrants to MDG that the Customer has appropriate experience and knowledge to make informed decisions to Booking Gold and/or Silver. The Customer acknowledges that the Customer has not relied on any information made available by MDG and that MDG is not making any recommendation with respect to such Bookings and/or Transfer/Redeem of Gold and/or Silver. No relationship other than seller-Booking, including, without limitation, any agent-principal relationship, any advisor-advisee relationship, any employee-employer relationship, any franchisee-franchisor relationship, any joint venture relationship or any partnership relationship, exists between the Customer and MDG.

The Customer acknowledges that MDG is not providing / dealing in / offering any investment product and does not offer any guarantee / assured returns. The Customer further acknowledges that value of Gold and/or Silver may vary depending on various factors and forces.

ELECTRONIC ORDER RISKS

Commercial internet service providers are not 100% reliable and a failure by one or more of these providers may affect internet-based Customer Request. The Customer acknowledges that the order entry system is an electronic mechanical system and as such may be subject to failure beyond the control of MDG. Therefore, MDG shall not be responsible for errors, negligence, inability to execute orders, delays in transmission, Redeem or execution of order due to breakdown or failure of transmission or communication facilities (including in any device used to connect to the Platform), or to any other cause beyond the control or anticipation of MDG

CONFIDENTIALITY

As elaborated under the Privacy Policy, MDG shall keep all confidential information confidential, including the Customer's personal information, and shall not disclose it to anyone except as required by law, and shall ensure that such confidential information is protected with security measures and a degree of care that it would apply to its own confidential information.

FEEDBACK

The Platform may allow Customer to post their review and experience of using the Platform ("Reviews") in order to improve the Platform and the user experience.

Customer, being the originator of the Reviews, are responsible for the Reviews that Customer upload, post, publish, transmit or otherwise makes available on the Platform. Customer represent that all such Reviews will be in accordance with applicable law. Customer acknowledges that MDG does not endorse any Reviews on the Platform and is not responsible or liable for any Reviews. MDG reserves the right to disable access to the Reviews on the Platform.

Customer further represent and warrant that while posting any Reviews on the Platform Customer shall not use any offensive, libellous, derogatory, hateful or racially or ethnically objectionable language. Further, Customer shall not post any content on any part of the Platform that is obscene, pornographic, constitutes an "indecent representation of women" as provided in the Indecent Representation of Women (Prohibition) Act, 1986.

CONTENT AND INTELLECTUAL PROPERTY RIGHTS

MDG solely and exclusively owns respective copyrights, trademarks, service marks, logos, trade names, and other intellectual and proprietary rights associated with the Services provided by MDG and displayed on/accessed on the Platform and is protected under Indian law.

Customer hereby acknowledge that the Services constitute original works and have been developed, compiled, prepared, revised, selected, and arranged by MDG respectively through the application of methods and standards of judgment developed and applied through the expenditure of substantial time, effort, and money and constitutes valuable intellectual property of MDG and such others.

Customer thereby agrees to protect the proprietary rights of MDG during and after the term of these Terms. Customer may not selectively download portions of the Platform without retaining the copyright notices. Customer may download material from the Platform only for the purpose intended by these Terms.

Any infringement shall lead to appropriate legal proceedings against Customer at appropriate forum for seeking all available remedies under applicable laws of the country.

LINKS TO THIRD PARTY WEBSITES

The MDG Platform used by the Customer, may contain links and interactive functionality interacting with the websites of third parties. The Customer may also be using the services of one or more third parties, such as a wireless carrier or a mobile Partner Platform provider, or an API provider. The Customer's use of these third-party services may be subject to the separate policies, terms of use, and fees of these third parties. MDG is not responsible for and does not have any liability for the functionality, actions, inactions, privacy settings, privacy policies, terms, or content of any such websites. Before enabling any sharing functions to communicate with any such website or otherwise visiting any such website, MDG strongly recommends that the Customer reviews and understands the terms and conditions, privacy policies, settings, and information-sharing functions of each such third-party website.

INDEMNIFICATION

Customer hereby agree to indemnify and keep the MDG indemnified from and against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses, directly or indirectly, whatsoever ("Losses") which MDG and/or its employees, agents, workers or representative may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of: (i) the usage of the Platform and/or any device used by the Customer to access the Platform; (ii) by reason of MDG acting in good faith and taking or refusing to take or omitting to take action on the Customer's instructions, and in particular arising directly or indirectly out of the negligence, mistake or misconduct of the Customer; (iii) breach or non-compliance of the Terms and relating to the Gold Account; and/or (iv) fraud or dishonesty relating to any transaction by the Customer.

DISCLAIMER OF WARRANTIES

The Platform and all information, content, materials, products (including software) and services included on or otherwise made available to the Customer through the Partner Platform are provided by MDG on an "as is" and "as available" basis, unless otherwise specified in writing. MDG makes no representations or warranties of any kind, express or implied, as to the operation of the Platform, the accuracy or completeness of the contents and the accuracy of the information. MDG shall have no responsibility for any damage to Customer computer system or mobile device or loss of data that result from the download of any content, materials, document or information or any other losses incurred by the Customer for use of the Platform. Customer expressly agrees that the use of the Platform is at the Customer's sole risk. MDG will not be liable for any damages of any kind arising from the use of the Platform or the services or the contents including, without limitation, direct, indirect, consequential, punitive, and consequential damages, unless otherwise specified in writing.

LIMITATION OF LIABILITY

Customer hereby acknowledge that MDG (including but not limited to its, directors, employees, agents or partners) shall not be held liable to Customer for any special, consequential, incidental, and exemplary or punitive damages, or loss of profit or revenues. MDG shall also not be liable under any circumstances for damages arising out or related in any way to Customer inability to access, or Customer difficulty in accessing the Platform to avail of any Services, any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Platform by any third party, any loss of Customer data, any claim relating to Customer data or content from the Services and/or Customer failure to keep the Gold Account Information secure and confidential. Customer further agree that MDG shall not be held responsible in any manner whatsoever for any and all acts or omissions of any Intermediaries or any other third party whosoever including (but not limited to) any person whose device has been used by Customer to access the Platform and/or any person appointed/nominated for the purposes of accepting/collecting any payments from Customer for the Booking of Gold.

AMENDMENT AND ACCEPTANCE TO THE TERMS

MDG reserves the right to make changes to our Platform, policies, and these Terms at any time. Such changes shall be posted on Partner Platform and shall be notified to the Customer prior to making such changes. Notwithstanding anything to the contrary, Customer shall be responsible for regularly reviewing the Terms of Use, including amendments thereto as may be posted on the Platform and shall be deemed to have accepted the amended Terms of Use by continuing the use of Partner Platform. Accessing, browsing or otherwise using the Partner Platform indicates the Customer's consent to all the terms and conditions under these Terms. The Customer is advised to read these Terms of Use carefully before proceeding. By impliedly or expressly accepting these Terms of Use, the Customer also accepts and agrees to be bound by all policies, including but not limited to MDG's Privacy Policy, as amended from time to time.

GST

If the customer does not take the delivery of goods after booking for more than 330 days, the customer is liable to pay the GST on the value of the Gold/Silver booked by him. The customer shall pay separately all the taxes he is liable to pay.

Cancellation Policy – My Dream Gold

The management of My Dream Gold reserves the right to terminate a user's membership and agreement if it is determined that the member has violated the terms and conditions, infringed upon the rights of My Dream Gold, or breached the privacy policy of My Dream Gold, its affiliated companies, or any third party.

Such termination may occur with or without prior notice. My Dream Gold is not obligated to provide advance notice before terminating a membership or restricting access to its website or mobile application. Upon termination, the member is required to delete or destroy any data, materials, or content obtained from My Dream Gold under the user agreement.

Termination of membership does not relieve the member of any outstanding payment obligations related to merchandise or other purchases.

You acknowledge and agree that My Dream Gold reserves the right to modify, suspend, or discontinue any of its platforms, services, or operations at any time, with or without prior notice. My Dream Gold shall not be held liable to you or any third party for such modifications, suspensions, or discontinuation.

Users may also voluntarily terminate their membership by submitting a written request to My Dream Gold, stating that they no longer wish to use its services or access the website or app. Such requests will be processed within 7 to 10 business days. However, any pending payments or dues must be settled prior to termination.
